1. Definitions
Rex-Cars or the Controller – REX-CARS Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków at ul. Praska 53/12A, 30-322 Kraków, entered in the National Court Register under KRS number 0001084541, NIP 6762661482, REGON 527555260. Personal Data – any information relating to an identified or identifiable natural person, directly or indirectly, on the basis of, inter alia, an identifier such as name and surname, identification number, e-mail address, telephone number, residential address, location data, Internet identifier (IP address), image, or information collected through cookies and other similar technology. Policy – this privacy policy. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. Agreement – an agreement concluded between the User or the person on whose behalf the User acts and Rex-Cars, covering in particular a passenger car rental service. Website – the website available at the address https://rex-cars.com, accessible via a web browser, operated and administered by Rex-Cars, enabling access to the Rex-Cars offer and the submission of enquiries through the contact form made available on the website. User – any natural person who uses the Website, browses its content or uses the services and functionalities available therein, regardless of the degree and frequency of use, including submitting enquiries regarding the offer to Rex-Cars via the Website.

3. Purposes and legal bases for the processing of personal data
Rex-Cars enables Users to use the Website and the functionalities available therein. In connection with this, Rex-Cars processes Users' Personal Data for the following purposes: - the provision of services by electronic means – legal basis: Article 6(1)(b) GDPR; - the conclusion and performance of the Agreement – legal basis: Article 6(1)(b) GDPR; - the performance of legal obligations incumbent on Rex-Cars – legal basis: Article 6(1)(c) GDPR; - conducting analyses and statistical research – legal basis: Article 6(1)(f) GDPR; - ensuring IT security – legal basis: Article 6(1)(f) GDPR; - the establishment, pursuit and defence of claims – legal basis: Article 6(1)(f) GDPR; - the handling of complaints – legal basis: Article 6(1)(b) GDPR.
4. Voluntary nature of providing personal data
The provision of Personal Data is voluntary but necessary for the use of the services provided by Rex-Cars or for obtaining a response to enquiries directed to Rex-Cars.
5. Period of processing of personal data
Personal Data will be processed for the period necessary for the fulfilment of the purposes of processing. As a general rule, this period covers the period of performance of the Agreement, the duration of the provision of the relevant service, or lasts until the withdrawal of consent or the filing of an effective objection to processing. In the case of cookies, Rex-Cars stores Personal Data until the expiry of the lifespan of the individual cookies or until the moment when the User deletes them from their device. The processing period may be extended if this is necessary for the establishment, pursuit or defence against claims. Upon completion of processing, Personal Data will be permanently deleted or anonymised.
6. Sources of personal data
Rex-Cars primarily processes Personal Data obtained directly from the User (e.g. name and surname, telephone number, e-mail address provided in an enquiry). Personal Data may also be obtained from other sources, including from persons granting a power of attorney or designating the User as a contact person. Rex-Cars also processes Personal Data concerning the activity of Website users and associated technical data, including data originating from cookies and other similar technologies.
7. Recipients of personal data
Users' Personal Data may be disclosed to: - third parties providing services to Rex-Cars, including IT service providers, courier companies, providers of analytical services, and entities providing accounting and advisory services; - public authorities, where this is reasonably required for the purposes of the establishment, pursuit, or defence of claims.
8. Transfer of personal data to third countries
Rex-Cars transfers data outside the EEA only where this is necessary and possible while maintaining appropriate safeguards. In practice, this means, inter alia:
a. establishing cooperation with entities located in countries which – by decision of the European Commission – offer an adequate level of protection of Personal Data. In certain cases, it may be necessary for a given entity to participate in international programmes recognised by the Commission, obliging it to apply EU standards (further information is available HERE);
b. the use of so-called standard contractual clauses (SCCs), which are officially approved by the European Commission. These clauses, together with additional safeguards, ensure that data will be protected in a manner comparable to the rules applicable within the EU (details of the SCCs are available HERE).
Users' Personal Data may be transferred to Google LLC (USA) in connection with the use of Google Analytics and Google Tag Manager, on the basis of an adequacy decision in connection with the Data Privacy Framework programme.
9. Users' rights
Persons whose Personal Data we process have the right to: - withdraw consent at any time; - access Personal Data and receive a copy thereof; - request the rectification or completion of Personal Data; - request the erasure of Personal Data; - request the restriction of processing; - object to processing; - lodge a complaint with the President of the Personal Data Protection Office (ul.
