Terms of Service for the website www.rex-cars.com
These Terms of Service set out the rules for using the Website available at the address "rex-cars.com", including the conditions for the provision of services by electronic means as specified in the Terms of Service. The Website is operated by the Service Provider.
1. Definitions
Contact Form – a Service provided by electronic means by the Service Provider within the Website, enabling Users to contact the Service Provider in connection with the services provided by the Service Provider. Reservation Form – a Service provided by electronic means by Rex-Cars within the Website, enabling Users to submit enquiries regarding the reservation of a car rental available in the Rex-Cars offer on the Website. Terms of Service – these Terms of Service for the Website, including the conditions for the provision of Services by electronic means available on the Website. Website – the website available at the address "rex-cars.com" operated by the Service Provider. Services – services provided by electronic means, as referred to in section 4 of the Terms of Service. Service Provider or Rex-Cars – the operator of the Website, i.e. REX-CARS Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków, at ul. Praska 53/12A, 30-322 Kraków, entered in the National Court Register under KRS number 0001084541, NIP 6762661482, REGON 527555260. User – any natural person who uses the Website and the Services available on the Website, browses its content or uses the functionalities available therein, regardless of the degree and frequency of use, including submitting enquiries regarding the offer to Rex-Cars via the Contact Form.
2. Rules for using the Website
- Rex-Cars provides Services to Users on the terms described in the Terms of Service. - Users may use the Website only in accordance with the rules set out in the Terms of Service. Acceptance of the content of these Terms of Service is a condition for using the Website. - The Website is of an informational nature and functions as a business profile of Rex-Cars, enabling Users to contact Rex-Cars within the framework of the Services. - The use of the Services is free of charge. The use of certain Services may require the User to provide personal data. - Rex-Cars can be contacted at the following e-mail address: samochody@rex-cars.com. - Rex-Cars makes the Terms of Service available free of charge prior to the conclusion of a contract on the Website and also enables the Terms of Service to be obtained, reproduced and stored on the Website, free of charge and without interruption.
3. Technical requirements
In order to use the Website, it is necessary to have: - a computer, laptop, smartphone or other end device with access to the Internet; - a web browser (EDGE, Firefox, Chrome, Safari) with cookies and JavaScript support enabled. In order to use the Services, it is necessary to have an active e-mail address and a telephone number. The use of the Website may involve the need to incur costs of connection to the Internet. Rex-Cars shall not be liable for indirect or direct damage connected with the temporary unavailability of the Website.
4. Services
Within the Website, Rex-Cars provides Users free of charge with Services consisting of: - enabling the submission of enquiries concerning the services provided by Rex-Cars via the Contact Form; - the submission of enquiries regarding the reservation of a car rental available in the Rex-Cars offer via the Reservation Form. The submission of an enquiry through the Contact Form or the Reservation Form does not constitute the conclusion of a rental agreement or the making of a reservation. By using the Contact Form or the Reservation Form, the User confirms that they have read the Terms of Service and accept all of its provisions. When using the Services, the User is obliged to provide truthful data. By confirming the submission of an enquiry, the User consents to being contacted by Rex-Cars via electronic mail and by telephone using the data provided by the User.
5. Conditions of rental and reservation of cars
A car rental agreement is concluded with the User after confirmation of the reservation by Rex-Cars and after the signing of an agreement with the User in written or documentary form. The conditions of rental, including the price, rental period, security and liability of the parties, are set out in the rental agreement. The lessee of the car may be the User or a legal person designated by the User, provided they meet the following requirements: - a natural person who has reached the age of 21, holding Polish citizenship, a permanent place of residence, and a driving licence valid in the territory of the Republic of Poland for a minimum period of 24 months; - a natural person who has reached the age of 21, not holding Polish citizenship, holding a driving licence valid in the territory of the Republic of Poland for a minimum period of 24 months, and a valid passport; - a legal person, represented by a User meeting the criteria set out above. All prices are quoted in Polish zlotys (PLN) and are gross prices including applicable VAT. The prices indicated on the Website are indicative and may be subject to change. The binding rental prices are set out in the rental agreement concluded between Rex-Cars and the User.
6. Intellectual property
Rex-Cars is the exclusive owner of the Website software and the content contained therein, including all copyrights, patents and other intellectual property rights. The User receives a non-exclusive, limited licence to use the Website solely for the purpose of using the Services, without the right to modify, copy or distribute.
